CAMPUS SEXUAL ASSAULT VICTIM'S BILL
OF RIGHT
Binghamton University is committed to ensuring that
any student who is the victim of a sexual assault receives fair, prompt,
and respectful assistance from all university personnel.
This Bill of Rights helps establish
university practices and processes for victims of sexual assault,
stalking, intimate or domestic violence and ensures appropriate and
compassionate treatment. Anyone who wishes clarification or
more information regarding their rights outlined herein may contact
the Dean of Students (607-777-4789) or the Student Handbook.
Victims shall have the right:
- To be treated with dignity and respect by all university
personnel.
- To receive assistance in a timely manner from university
personnel in reporting the assault, intimate violence or stalking
incident.
- To receive prompt victim-sensitive assistance from
university personnel regarding evidence collection and medical examinations.
- To have reported sexual assaults duly investigated
by appropriate campus authorities.
- To be free from pressure that might discourage
reporting a sexual assault or lead to reporting a sexual assault
as a lesser offense.
- To have access to campus medical and counseling
services under the same terms and conditions that apply to other
students seeking such services.
- To be informed of and assisted in exercising any
rights to confidential or anonymous testing for sexually transmitted
diseases, HIV and/or pregnancy.
- To be notified of campus and community victim services
whether or not a police or other report is filed.
- To be accompanied by a person of their choice (e.g.
family member, friend, victim advocate) during questioning and interviews
by university authorities. (Please refer to campus judicial

- To have the university take reasonable steps to
prevent intimidation and unwanted contact with the accused, including
notifying victims of options for changing academic and living situations
and assisting victims in pursuing those options.
- To have all administrative and logistical needs
pertaining to the gathering of information, scheduling of hearings,
etc. handled with sensitivity and compassion.
- To be informed about the campus judicial process
and to be notified of the case progress and final disposition.
- To be afforded the same right as the accused to
assistance and advisement regarding the campus judicial system.
- To have a secure, but not necessarily separate,
waiting area during campus judicial proceedings.
- To have the same right to have others present in
campus proceedings as the accused.
- To deliver a victim-impact statement at an appropriate
point in the campus judicial proceedings.
